Docket reviewed through September 30, 2026; no final resolution established
[S39]Dates reflect the records reviewed.
What the records show
The HOA obtained an order rejecting its RowCal management agreement. A later order gave RowCal Construction limited permission to join the HOA in a state lien case. Both RowCal entities filed claims for payment. [S41] [S46] [S48] [S49]
Limits of this entry
The bankruptcy is the HOA’s case, not a bankruptcy filed by RowCal. The contract-rejection and stay-relief orders do not establish misconduct, decide the validity or amount of the liens, or award damages. The October 1 docket snapshot ends September 30. No settlement, confirmed plan or final claims determination is established by the reviewed records. The related state cases describe parts of the same dispute.
What the court ordered
Management agreement rejected
On August 17, 2026, the court granted the HOA’s unopposed motion and deemed its RowCal management agreement and related unexpired contracts rejected at the end of July 31, 2026. The order does not make findings on the alleged breaches. [S41] ECF 40, p. 1
Limited permission for RowCal’s lien case
On September 22, 2026, the court allowed RowCal Construction to add the HOA to 2026CV31849 and record a lis pendens to determine lien priority. RowCal may not seek a money judgment, deficiency judgment or damages against the HOA in that action without another bankruptcy-court order. The stay otherwise remains in force. [S46] ECF 67, pp. 1–2
The HOA’s allegations and RowCal’s position
HOA alleges an unauthorized reserve transfer
The HOA alleges a $100,000 reserve-account transfer to pay RowCal’s counsel, along with insurance non-compliance, communication failures and inaccurate status letters. It says continuing the management agreement would burden the estate. These are the HOA’s allegations. [S40] ECF 14, p. 2, ¶ 7
HOA disputes lien timing and allocation
The HOA says RowCal described completion of work in November 2025 and later recorded untimely liens, including against homes whose owners had paid in full. The report recounts the HOA’s position; it does not decide lien validity. [S45] ECF 46, pp. 2–3, ¶¶ 6–9
RowCal says the work was completed and payment remains due
RowCal states that its work passed inspection, that it was not fully paid and that it timely recorded liens for $722,600.37 in principal. It sought limited stay relief to address the HOA’s joinder and lien priority. [S42] ECF 41, pp. 3–6, ¶¶ 7–20
Claims filed by RowCal
Construction: $857,460.69 claimed
Claim 19’s itemization lists $722,600.37 principal, $58,441.54 interest, $65,755.00 attorney fees and $10,663.78 costs. These are amounts requested in a creditor filing. The sheet reverses the creditor/debtor labels; the claim identifies RowCal Construction as creditor. [S48] Claim 19-1, part 3, p. 1
Security asserted against individual homes
The construction claim’s addendum says RowCal believes its claim is fully secured by non-debtor property: the individual townhome lots. This statement does not establish that the bankruptcy court allowed that secured status. [S47] Claim 19-1, part 2, p. 1
Management: $24,419.97 claimed
Claim 20’s addendum seeks nine remaining months of fees following rejection: a monthly management fee of $2,520.00 and administrative expense of $193.33, totaling $2,713.33 per month. No award of this amount is established. [S49] Claim 20-1, part 2, p. 1

Assessment case: 2025CV32121
The state amended complaint uses 2025CV032121; the homeowners’ counterclaims use 2025CV32121. ECF 46’s reference to 2024CV32121 conflicts with those pleadings. This archive uses the state captions and retains the discrepancy in its source notes. [S43] ECF 41-1, p. 1; compare ECF 46, p. 1, ¶ 4
