What the records show

Limits of this entry
The July 31, 2026 complaint and exhibits were obtained as a 440-page bankruptcy exhibit. The complaint’s relevant allegations and relief were reviewed; the entire exhibit packet has not been substantively reviewed or cleared for public hosting. The August 7 state stay order and current state register are still needed. A third-party “case closed” entry does not establish a merits result. The September 22 bankruptcy order does not itself establish that the HOA was subsequently joined.

RowCal alleges that it substantially completed contracted work by February 2026, that roofing inspections passed and that $722,600.37 remained unpaid. The complaint seeks lien-validity and priority determinations, foreclosure and court-ordered sales. Its second claim alternatively seeks restitution from equitable owner defendants for uncompensated benefits. Requested relief includes recoverable interest, fees and costs; no award is established. Disputed timing and bankruptcy limits
HOA disputes the liens
In its bankruptcy report, the HOA disputes lien timeliness based on November 2025 completion communications and says liens also reached homes whose owners had paid. This is the HOA’s position, not a ruling on the liens. [S45] ECF 46, pp. 2–3, ¶¶ 6–8
September 22 order allows limited joinder
The bankruptcy court allowed RowCal to join the HOA for lien priority and record a lis pendens. It prohibited RowCal from seeking a money judgment, deficiency or damages against the HOA in that action without a further order. Other stay protections remain. [S46] ECF 67, pp. 1–2
